On November 3, 2022, Talia G. Damrow and Ryan P. Browne with the Billings office of Hall & Evans presented before a large, regional healthcare provider. Their presentation focused on a situation that commonly arises in a clinical setting: what happens when a medical decision needs to be made and the patient is incapable or unable to make the decision? Montana law pertaining to guardianships, medical proxy decisionmaker, Rights of the Terminally Ill Act, and powers of attorney were explored. The utility of, and interplay between, these legal mechanisms was also discussed. If you have any questions about this update, please contact Talia G. Damrow or Ryan P. Browne.
