Community Association Law
An increasing number of homeowners live in common-interest communities. Hall & Evans represents both residential and commercial common-interest communities in a wide range of matters serving as both general counsel and litigation counsel. From small associations to large master-planned communities, our clients range in size, complexity, and need. Our attorneys have experience working with all types of communities and associations.
The law applicable to most associations is complex and imposes strict legal requirements affecting the way associations conduct their business and make decisions. Our goal is to provide practical and cost-effective advice to assist with the challenges associations face.
Hall & Evans serves as legal counsel for residential common-interest community homeowner’s associations (HOA) and commercial associations before courts, state and federal agencies, and alternative dispute resolution (ADR) tribunals. Our experience generally includes representation of association interests in construction and design, corporate law and governance, contracts, fair housing, real property interests, disability discrimination, and transactional matters.
As association corporate general counsel, we advise association clients on day-to-day issues, including governing document interpretation, covenant compliance and enforcement, officer and director fiduciary duties, contract interpretation, reasonable accommodations, homeowner disputes, vendor relationships, collections, coordination with municipalities and government, and a wide variety of real property issues.
