Benton Barton’s article, “Property Owners Must Consider Designing for Security,” was published in the December 2022 issue of the Colorado Real Estate Journal. The article examines the potential for litigation against landowners following mass shootings, and the expansion of the owner’s arguable responsibility to vicitims and family members. As premises liability lawsuits are increasing against owners and designers of public and private spaces, owners must be aware of shifting dynamics they face and the possibility of increased exposure from claims, lawsuits, and jury verdicts. Benton discusses security-focused design, critical issues litigated after mass shootings, and how jury attitudes have evolved following these tragedies in recent years.
